The 43-page indictment of former Virginia governor, Robert McDonnell, and his wife, Maureen, is a heck of a good read. In July, 2011, Jonnie R. Mathew Martona Had His Ethics and Compliance Training — Every Year

Mathew Martoma, the former SAC Capital portfolio manager, who is on trial for insider trading, participated in SAC’s annual ethics training. He signed the attendance sheet and was trained by the company compliance officer who used PowerPoint slides to explain insider trading. Mr. Martoma allegedly obtained information about the results of drug trials in advance of a pharmaceutical’s public announcement about those results. The doc who allegedly tipped him off has testified about the tip in exchange for immunity. It takes more than ethics training. The culture at SAC countermanded what compliance and training tried to do. Check-the-box training and compliance won’t do it. Check the profits and how they earned them — they provide the real story.

Thank goodness Air Force Secretary Deborah Lee James called the 34 officers’ conduct of cheating on their proficiency tests, “unacceptable.” Thank goodness also that the 34 officers involved have lost their certification. The incompetent and dishonest launching nukes is a combo we could probably do without. Ms. James will travel to the testing site to discuss what to do in the future. Good luck with that — if the Air Force needs training, the Barometer has 37 years of teaching experience and an equal number of years in experience with cheating test takers. Where there are tests and humans, there will be cheating. The trick is to anticipate how before you have a headline.

Frank DiPascali, former right-hand man to Bernie Madoff, describing the reality that be could be sentenced to 125 years in prison for his role in the $50-billion Ponzi scheme he helped Mr. Madoff to run — on and on — for 18 years. In his many days on the stand, Mr. DiPascali has been nothing, if not colorful. He expressed regret that he never got to speak personally with former Madoff client, actress Kyra Sedgwick, but could not muster much reaction when asked about snookering Nobel winner and former Madoff client Elie Wiesel out of millions, “I don’t have any feeling about it one way or the other.”

Dennis Kozlowski, former CEO of Tyco, who was convicted of theft of $100 million from Tyco while serving as its CEO. He served 8 years of his 8 1/3 to 25-year sentence, and will be released in January 2014. He was denied parole in April 2012 because the parole board found “his theft of over $100 million from Tyco,” and that such was not compatible “with the welfare of society at large.”

Mr. Winston won the trophy by 1,501 votes — the seventh-widest margin ever. Sports Illustrated, December 23, 2013. p. 38 Mr. Winston was investigated for rape, but no charges were filed. Perhaps clay beneath the feet of the figurine on the Heisman trophy would be an appropriate change to make at this point in its history.

Mickey Sherman, criminal defense lawyer and ubiquitous “Court TV” presence.  A Connecticut court ruled this week that Michael C. Skakel was entitled to a retrial on his murder conviction because of Mr. Sherman’s failures in his representation of Mr. Skakel. The judge called Sherman’s efforts (or lack thereof) in the case  “fatal to a constitutionally adequate defense.” Mr. Sherman was paid $1 million for defending Mr. Skakel.

The Profligate Bishop Sacked by the Pope

Pope Francis is a man of humility and modesty.  He connects with people and demonstrates love for them.  Add one more quality to this Pope’s toolbox — he’s a darn good manager. Pope Francis suspended the Bishop of Limburg for spending $42 million in renovations for his residence.  Bishop Franz-Peter Tebartz-van Elst has joined the ranks of the likes of Dennis Kozlowski, the former CEO of Tyco, who had Tyco pay for $6,000 a shower curtain for his New York City apartment remodeling.  Mr. Kozlowski currently resides in the New York state hoosegow doing penance for embezzlement.  There is also John Thain, former CEO of Merrill Lynch, who had Merrill pay for his office remodeling when he took over as CEO, including $87,784 on two guest chairs and $35,115 for a commode on legs (whatever that is).  To his credit, when news of the remodeling hit the media, Mr. Thain paid Continue reading

Lawyer for Rebecca Mairone, a former Countrywide executive who headed up the “Hustle” loan program, a program that resulted in $1 billion in bad mortgage loans that were subsequently dumped on Fannie Mae. A jury concluded on October 22, 2013 that the loans were indeed fraudulent and held Ms. Mairone civilly liable for the fraud. Her fines and penalties are yet to be determined.  JPMorgan Chase was lucky enough to scoop her up and now has her on staff.
