“Now Vince has random people working full time on random research projects in standard,’churn that bill, baby!’ mode. That bill shall know no limits.”

An e-mail from a DLA Piper lawyer to colleagues about the firm’s billing pactices for Adam Victor’s Trans Gas Developmnet Systems.  Mr. Victor has filed suit against the firm for overbilling.  Rightfully so.

“I still deal with my lender, and they threaten with legal action now and again.”

Ben Gilroy, living in an underwater mortgage property, who has not made a mortgage payment in two years.  That’ll keep the social norm going!  Has this man no money?  Could he pay a little?  Does he feel no obligation to pay?  His glib description sums up our new world of, “Contract?  What contract?”

After the Chase Hearings and After All We’ve Been Through … “Who Knew?” Remains a Defense

Chase was the bank the others were to model.  Jamie Dimon was its unflappable leader.  But the loss of, oh, say, $6 to $8 billion dollar through whopping trades made by the infamous “London Whale” trader brought the bank under the microscope and its leaders to Washington for testimony before the Senate Permanent Subcommittee on Investigations. If you were expecting accountability and an understanding of what went wrong, well, you were dreaming.  The blame went up the ladder to Mr. Dimon and down the ladder to the whale and other traders, but the here’s the crux of the testimony, “Not my job,” and “I didn’t know.”

I offer one quick summary from an executive friend of mine, “If it happens at your company while you are there, it is your fault. Continue reading

“The one who is highest up must be at the service of others.”

Pope Francis.  The quote holds all the more meaning when you realize it comes from a man who wears his old black walking shoes instead of the red papal shoes and called himself to cancel his newspaper back in Argentina, beginning the conversation with, “This is Jorge.” Oh, if we could get this kind of humility in business executives.  What leaders they could be then.

“Stupid”

A word Chase Bank executives hurled at bank examiners who were concerned about seeing records, the Bank’s risk exposure, changes in risk procedures, and use of federally guaranteed funds for the London Whale’s operations.    Chase lost between $6 and $8 billion from the London Whale’s activities.  The Senate Banking Committee report on Chase’s losses is damning.  The report’s summary of management’s behavior during the mounting risk exposure and ultimate losses is a study in hubris. Ad hominem attacks on regulators don’t change the fact that you are in over your head.  Withholding information from regulators does not change reality.   Stupid is as stupid does.

The Princess Who Understands Conflicts and the “Schlub” Factor

Unlike other royals and celebrities, the Duchess of Cambridge (aka Kate Middleton) does not accept free clothes from designers. Sacre bleu! A royal who understands conflicts of interests! Why, most of them don’t even understand conflicts of interest within the bounds of matrimony, i.e., dating another whilst married does tend to create conflicts. The Duchess, who will one day be queen, pays for her clothes. She even goes to shop for her own clothes. Oh, if she could just do Continue reading

Truth (and Falsehood) Occupy Both Sides of the Aisle

As an aging baby boomer, the Barometer has been tickled to see Watergate sleuth/reporter, Bob Woodward, landing on the wrong side of a Democratic president.  Mr. Woodward and his Washington Post colleague, Carl Bernstein, were the bane of the Nixon White House’s existence during the Watergate scandal.  From that point forward, Mr. Woodward  became the dean of journalism with his books used as definitive history for any administration.

However, Mr. Woodward crossed a line when he stood Continue reading

Oreos at Walmart or $5,000 Hermes Handbags at Neiman’s: Regardless of What You Swipe, It’s All Stealing

Two stories of theft caught the Barometer’s attention.  Penny Winters, a 63-year-old  maintenance worker at Walmart, faces felony charges for years of stealing Oreos and other snack foods whilst working her evening shifts at Walmart.  Quite simply, she wanted some junk food and simply could not afford these luxuries on her $11.40 per hour salary. Stare cameras have the snacking on video.  And then there is Elba Esther Gordillo, the most powerful woman in Mexico who is head of the teacher’s union, who was arrested on charges of embezzling $200 million in union funds. Prosecutors allege that she spent $2.1 million at a San Diego Neiman Continue reading

“The cost is costing us huge $$$$.”

From a Peanut Corporation of America 2009 e-mail from owner, Stewart Parnell, as reflected in a February 2013 Department of Justice  indictment charging executives and managers with knowingly shipping tainted product. The DOJ filed a 76-page indictment against three former managers and employees and a food broker of Peanut Corporation of America (now bankrupt) with charges of criminal fraud.

Peanut Corporation produced the peanut base used in peanut butter, cookies, and crackers, and in 2009, salmonella was discovered in the company’s product.  Once you find salmonella at a food production plant, here’s a safety tip:  close the place down and hose it out just a bit.  Instead, the indictment alleges Continue reading

“Your plumber may have had a horrible divorce, but he’s still a very capable plumber.”

Former South Carolina Governor Mark Sanford on announcing that he is throwing his hat into the ring in order to win back the seat he once held in the House of Representatives.  Yes, but if your plumber left the job he was working on at your house to have a fling even as he billed you for the work, you would want a little space before you trusted him again.  Mr. Sanford disappeared while he was governor for an alleged Appalachian Trail retreat Continue reading

“It’s not like Johnny is going to be at the cusp of committing fraud and then think back to his b-school days and think, ‘gee, Professor Goody Two Shoes wouldn’t approve.’”

MBA student reflecting online about ethics in business schools. Poor confused student, destined for ethical challenges elaborating on a new academic consortium trying to get ethics back in business schools.  The Wall Street Journal ran an article on such on February 7, “Does an “A’ in Ethics Have Any Value?”

Not again with the
academic ethics whiners. Yes, yes, we have had the Milkens,
the Keatings, the Skillings, the Leesons, the
Scrushys, the London Whales, and on it goes. Each time
another Madoff hits, the academy pledges to do more business ethics. Yet
the scandals continue with shorter lag times. We were on a decade
schedule, but we didn’t make it five years out from Sarbanes-Oxley before we had
to face Dodd-Frank. The academy misses key points:

1. The topics of diversity, sustainability, and human rights dominate business ethics texts and curricula. How about if we stop accounting fraud first and then work up to saving the
world?

2. Business ethics is business history – there are no new sins; the old ones just need more publicity. Ezekiel (22:29) had his arms around the notion of laddering long before the investment banks used the tool in the 1920s, which was no different from 2008 when those same banks had been taking positions against what they were selling to their own
customers.

3. Incentives and maximizing shareholder v Continue reading

Have you ever hidden a purchase from your spouse?

An AARP survey indicates that 34% of us have hidden purchases from our spouses.  There’s something about marriage because 52% of us confess to cheating in school.  Love may not conquer all but it seems to conquer 18% of our lesser selves.

Faith of a Mustard Seed, or A German Shepherd

Ciccio is a resident of Brindisi, Italy who happens to be a German Shepherd.  Up until last November, Ciccio went to Mass every afternoon with his owner. When she passed away in November, Ciccio accompanied the pall bearers to the church for her funeral.  Since the day of that funeral in November, Ciccio, upon hearing the bells for Mass, heads to the church.  He plops in front of the priest and stays for the full service. The good father does not have the heart or mindset to chase him away.  Parishioners give Ciccio food and water, and the patient padre at the church hopes someone adopts him soon.  Dogs are indeed loyal, in this case to their master as well as their Creator.  Ciccio’s church attendance record is rarely seen in our day.  The simplicity of faith.  The beauty of love.

Enjoy pictures of this magnificent creature here: http://now.msn.com/ciccio-the-german-shepherd-attends-church-every-day-since-owner-died

“I didn’t deserve to win it.”

Ivan Fernandez Anaya,  the world-class runner who stopped short of crossing the finish line in a cross-country race in Burlada, Spain because he realized that Abel Mutai, who had held a comfortable lead throughout the race, thought he had crossed the finish line but had stopped short (10 yards). His Kenyan not being as good as his Spanish, Ivan motioned and gestured to Abel to cross the finish line ahead of him.  Abel caught on, finished first, and Ivan took second place. Ivan’s coach said he “wasted an opportunity.”  Ivan responded, “I did what I had to do.”  The Barometer suspects that Ivan will have many successful races ahead in his life.  The Barometer knows that those victories will be all the sweeter because of his actions in this race.  Ivan has rescued us from the Armstrong blues.  In a world in which rationalizations abound, his decency and definitive standards are  rare and, oh, so welcome.
